This Privacy Policy is binding on all Premier Infusion Care personnel, including employees, contractors, service providers, volunteers, students, and all healthcare providers who deliver care at our facilities. Please review it carefully.
1. Introduction
Premier Infusion and Healthcare Services, Inc. (“Premier Infusion Care,” “we,” “us,” or “our”) is committed to protecting the privacy and security of your personal information and protected health information (“PHI”) in accordance with the Health Insurance Portability and Accountability Act (“HIPAA”). This Privacy Policy describes how we collect, use, share, and protect this information when you use our mobile application (“App”), visit our website, or receive healthcare services from us.
This Privacy Policy applies to:
- Our mobile application available on Google Play Store and Apple App Store (iOS)
- Our website and online platforms
- Healthcare services we provide to patients
By using our App or website, you agree to the practices described in this Privacy Policy. This policy is governed by applicable federal and state laws, including but not limited to HIPAA, the California Consumer Privacy Act (“CCPA”) as amended by the California Privacy Rights Act (“CPRA”), the California Confidentiality of Medical Information Act (“CMIA”), and other applicable California state and federal privacy regulations.
This Privacy Policy is binding on all Premier Infusion Care personnel, including employees, contractors, service providers, volunteers, students, and all healthcare providers who deliver care at our facilities.
We understand that your medical and personal information is private. Each time a call is made, a medication is delivered, or a nurse conducts a visit, a record is created. We are committed to protecting the privacy of those records.
Some of the information we collect, such as device, usage, and website data gathered through our App, is covered by California’s privacy law, the CCPA, and your rights regarding that information are described in Section 6. Your medical and treatment information is protected by HIPAA, a federal health privacy law, and your rights to that information are described in Section 7. This Policy explains both.
2. Information We Collect
Premier Infusion Care collects personal information and protected health information in connection with the healthcare services we provide and through your use of our mobile application and website. When you register for an account, schedule services, or communicate with us, we collect information you provide directly, including but not limited to contact information, profile details, health and treatment information necessary to provide care, insurance and payment information, and any inquiries or feedback submitted through the App, website, phone, or email.
- Information Collected Automatically Through the App
When you use our mobile application or visit our website, certain information may be automatically collected from your device and your interactions with our platforms. This includes technical information about your device, usage and activity data, and diagnostic information used to operate, maintain, and improve our services.
- Information We Receive from Third Parties
We may also receive information about you from third parties involved in your care or the administration of your benefits, including healthcare providers, health plans, and service partners who support the technical operation of our platforms on our behalf.

3. Why We Collect Your Information (Business Purposes)
We collect your personal information only for legitimate business purposes, and we limit our collection, use, and retention of that information to what is reasonably necessary and proportionate to achieve those purposes.
Under the CCPA, a “business purpose” means the use of personal information for our or a service provider’s operational purposes, or other notified purposes, provided that the use is reasonably necessary and proportionate to achieve the purpose for which the information was collected or processed, or for another purpose that is compatible with the context in which it was collected. Consistent with that definition, and as documented in our internal CCPA data collection assessment, we collect and use each category of information for the following specific business purposes:
- Account Creation and Authentication. We collect identifiers such as your name, email address, and phone number to create and manage your account, authenticate your identity, and capture basic user demographics.
- Delivering App Functionality and Healthcare Services. We collect customer records such as your signature and insurance policy number, and clinical information such as your date of birth and medical conditions, to fulfill the functionalities of our App through secure, encrypted integration with backend electronic health record systems and to support your clinical assessment and care.
- Support, Security, and Service Improvement. We collect internet and network activity information, such as your IP address, device type, browser type and language, access times, and operating system, to provide technical support, monitor and maintain performance, troubleshoot issues, enhance the user experience, secure our platforms, and analyze how our services are used.
- Location-Based Features. We collect general geolocation information derived from your IP address to enable certain features within the App.
- Device-Level Authentication. Where you enable it, biometric authentication (such as faceprint or fingerprint) is processed solely on your device to verify your identity; we do not collect or store this information.
- Telehealth and Real-Time Communication. We facilitate telehealth appointments through third-party video platforms (Microsoft Teams and, for patient convenience, FaceTime). From time to time, we record the audio and video of telehealth sessions conducted via Microsoft Teams for quality control and internal reference purposes. These recordings are used solely for quality control and internal reference; they are not used to make clinical decisions and are not maintained in your official medical record.
We do not collect personal information for purposes that are incompatible with those described above. If we intend to use your information for a purpose that is materially different from those disclosed at the time of collection, we will provide notice and, where required by law, obtain your consent before doing so. The specific periods for which we keep each category of information, and the legal and operational reasons for those periods, are described in Section 10 (Data Retention).
4. How We Use Your Information
We use the personal and health information we collect to provide and support the healthcare services you receive, operate and improve our mobile application and website, and fulfill our legal and operational obligations. In all cases not addressed by this Privacy Policy, we will obtain your separate written authorization before using or sharing your medical information. You may withdraw that authorization at any time by notifying us in writing, though any use or disclosure already made in reliance on your authorization cannot be undone.
5. How We Share Your Information
We do not sell your personal information or protected health information. We may share your information in the following circumstances:
- Business Associates and Service Providers. Third-party vendors who perform services on our behalf, known under HIPAA as “Business Associates,” are required by law and written agreement to protect your information and may only use it for the purposes for which it was disclosed. This includes third-party communication platforms used to deliver telehealth services, such as Microsoft Teams and Apple FaceTime.
- Healthcare Providers. Physicians, hospitals, pharmacies, and other providers involved in your treatment and care coordination.
- Insurance and Payment Entities. Your health insurer, pharmacy benefit manager, or other payers, to process claims and obtain payment.
- Legal and Regulatory Requirements. In response to a court order, subpoena, government regulation, or public health authority request as permitted under applicable law.
- Emergency Situations. With family members, caregivers, or disaster relief organizations when necessary to protect your health and safety.
- Business Transfers. In a merger, acquisition, or sale of all or part of our business, with notice to you as required by law.
6. Telehealth Communications and Recordings
We offer telehealth appointments through third-party video conferencing platforms, including Microsoft Teams and, for your convenience, Apple FaceTime. From time to time, telehealth sessions conducted through Microsoft Teams are recorded for quality control and internal reference purposes only.
Where a telehealth session will be recorded, we will inform you, and by proceeding with a recorded telehealth appointment, you consent to the recording for the purposes described in this Policy. If you do not wish to be recorded, you may request that your session not be recorded. Telehealth recordings are used solely for quality control and internal reference, are not used to make or document clinical decisions, and are not maintained as part of your official medical record. These recordings are retained in accordance with Section 10.
7. Additional Protections for Sensitive Health Information
Certain categories of health information receive additional privacy protections under state and federal law, and we apply heightened care to information related to mental health and psychiatric conditions, substance use disorder, HIV/AIDS status, reproductive health, genetic information, communicable diseases, sexual orientation and gender identity, and minors. Where multiple laws apply, we follow the law that provides the greatest protection for your information.
8. Your California Privacy Rights
If you are a California resident, you have rights under the CCPA, as amended by the CPRA, with respect to personal information that is not protected health information. These rights may include:
- Right to Access and Confirm. Users can access their personal information and confirm whether Unwind Media is processing their data.
- Right to Correct and Delete. Users can request the correction of inaccurate personal information and the deletion of their collected data.
- Right to Obtain Copies. Users can request copies of the Personal Information collected about them, where feasible.
- Right to Opt-Out of “Sales”. Users can opt out of data sales, sharing, and targeted advertising practices. To opt out of this, click the “Do Not Sell My Info” link located in the footer of the Site.
- Right to Limit Sensitive Information. Users can request limits on the use and disclosure of sensitive personal information, and in some cases, Unwind Media must obtain consent before processing such data.
- Right to Non-Discrimination. Users are protected from discrimination for exercising their privacy rights.
- Protection from Automated Decisions. You have the right not to be subject to automated decision-making that: (1) Creates legal effects concerning you; and (2) Significantly impacts you.
- Exercising These Rights. We’re here to help you understand and use your data privacy rights. If you have questions about these rights or want to exercise them, please contact us at info@premierhcs.com.
Premier Infusion Care does not sell or share personal information as those terms are defined under California law, and has not done so in the preceding 12 months. California residents may exercise applicable rights by contacting our Office at info@premierhcs.com with the subject line “California Privacy Request.” We will verify your identity and respond within the timeframes required by law (generally 45 days, extendable to 90). You may use an authorized agent to submit a request.
California “Shine the Light” Disclosure
California Civil Code Section 1798.83, known as the “Shine the Light” law, permits California residents to request certain information regarding our disclosure of personal information to third parties for those third parties’ direct marketing purposes.
Premier Infusion Care does not disclose your personal information to third parties for their own direct marketing purposes. Accordingly, we are not required to maintain or provide a Shine the Light response. If our practices change, we will update this Policy and honor any applicable requests.
California residents who wish to make an inquiry under this law may contact us at info@premierhcs.com with the subject line “Shine the Light Request.”
9. Your Rights Under HIPAA
For your medical and treatment information (PHI), you have the right to:
- Access. Request access to and a copy of the PHI and personal information we maintain about you.
- Correct. Request correction of inaccurate or incomplete information. We may deny the request if the record was not created by us, or is accurate and complete, and we will explain in writing.
- Restrict. Request limits on certain uses or disclosures, including restricting disclosure to your health plan for services you paid for entirely out of pocket.
- Confidential Communications. Request that we communicate with you in a specific manner or at a specific location.
- Accounting of Disclosures. Request a list of certain disclosures, other than those for treatment, payment, or healthcare operations.
- Paper Copy. Receive a paper copy of this Policy at any time on request.
- Breach Notification. Be notified in the event of a breach of your unsecured PHI.
- File a Complaint. File a complaint if you believe your privacy rights have been violated.
To exercise any of these rights, please contact our Office using the information in Section 15. We will respond within the time required by applicable law. If we deny your request, we will provide a written explanation, and you may have the right to appeal that determination.
10. Data Retention
We retain your personal and health information only as long as necessary to fulfill the purposes outlined in this Privacy Policy, to provide you with ongoing healthcare services, and to comply with our legal obligations under applicable federal and state law. Our retention practices vary by the type of information:
- Account and App Data (Identifiers, California Customer Records, Internet/Network Activity, Geolocation). Retained for up to 10 years, or deleted upon your verified request, except where we are required to retain it to comply with legal obligations, resolve disputes, or enforce our agreements.
- Telehealth Recordings. Where a telehealth session is recorded for quality control or internal reference purposes, the recording is retained for 12 months and then securely deleted, unless we are required to retain it longer to comply with a legal obligation.
- Medical and Health Records (PHI). Retained in accordance with HIPAA and applicable California medical-record retention requirements. California law generally requires that adult patient records be retained for at least 7 years from the date of the last encounter, and that records of minors be retained until the patient reaches the age of majority plus the applicable retention period. Because these records are subject to mandatory retention laws, a request to delete personal information will not result in the deletion of the underlying medical record where retention is legally required.
When information is no longer needed and retention is no longer legally required, we securely dispose of or de-identify it.
11. Safeguards
We are committed to protecting your personal and health information and maintaining commercially reasonable administrative, physical, and technical safeguards designed to protect your information from unauthorized access, use, disclosure, alteration, or destruction. These safeguards include data encryption, secure storage, access controls, employee training, and written policies and procedures governing the security of your information. Forms linked from our website are hosted on a secure, HIPAA-compliant third-party platform, and no PHI is collected, stored, or transmitted directly through the website. While we take these precautions seriously, no method of electronic transmission or storage is completely secure, and we cannot guarantee the absolute security of your information.
12. Cookies and Tracking Technologies
Our website and mobile application may use cookies, web beacons, and similar tracking technologies to collect usage information and support the functionality of our platforms. You may manage cookie and tracking preferences through your browser or device settings, though disabling certain technologies may affect the availability of some features.
13. Children’s Privacy
Our mobile application and website are not directed to children under 13, and we do not knowingly collect personal information from children under 13 without verified parental consent. We do not knowingly sell or share the personal information of minors under the age of 16. If we learn that we have inadvertently collected personal information from a child under 13, we will promptly delete it. If you believe we may have collected information from a child, please contact us immediately using the information in Section 12.
14. Non-Discrimination and Language Access
Premier Infusion Care complies with applicable federal civil rights laws and does not discriminate on the basis of race, color, national origin, age, disability, or sex in our health programs and activities. If you need language assistance, translation services, or other accommodations, please contact us, and we will make reasonable efforts to accommodate your needs. If you believe we have failed to provide these services or have discriminated in another way, you may file a complaint with the U.S. Department of Health and Human Services, Office for Civil Rights at https://www.hhs.gov/ocr or by calling 1-800-368-1019 (TDD: 1-800-537-7697).
